Prosecution in cases of cruelty to animals is unusual; laws are rarely enforced; and huge sectors of industry like factory farming, slaughterhouses, pharmaceutical testing, and experimentation on animals are exempted. In legal terms, animals are considered members of a class without individuals. Even if we recognize differences among species, historically and legally we do not recognize indi32 the right to remain silent vidual animals. In fact, traditionally the uniqueness of human beings, who have legal proper names, has been opposed to animals, who supposedly are all alike in their slavish adherence to natural law.
The recent protections of rights to life and freedom for the great apes does not prohibit their use in zoos, despite limiting their freedom by living in captivity. Even though people may not be captured, tagged, and bred in captivity, they are nonetheless measured, counted, and regulated in less conspicuous ways, particularly now with the heightened security regulations in place for our protection. The ways in which the liberty and freedom afforded by protective rights also bring increased regulations is more apparent when we consider animal rights, but they should also give us pause in terms of human rights.
The repressed always returns. Indeed, even within the confines of various philosophical texts, animals cannot be contained. They break free of the roles defined for them by philosophers and, like the white tiger Montecore, bite back. Whether a love bite, a rescue attempt, an enraged reproach, or just the distraction of a big-haired woman in the front row, we cannot be certain; we will never know. Perhaps animals bite back because it is man who first bites the hand—or paw, claw, talon, hoof—that feeds him.
